Terms and Conditions


1. Applicability



The following terms and conditions apply to all orders made through this online shop. Our online shop is intended purely for consumers. 
A consumer is every natural person, who makes a transaction for reasons not caused by commercial or independent occupational purposes. An entrepreneur/contractor is a natural or judicial person or a person having legal capacity that acts to exercise a transaction to follow their commercial or independent occupational employment.


2. Contract partner, conclusion of contract



Contract partner with TONMODEN ∆ GREEN CREATIVE STUDIO is exclusively Ivonne Kleine, Niehaeger Str. 5, 18347 Ostseebad Ahrenshoop (henceforth called TONMODEN).
With the placement of products in the online shop, TONMODEN makes a binding offer towards these artefacts. You can place our products into the basket without obligation and change your entries before your binding order at any time, for that you can use the tools explained in the explanation on how to make an order. The contract forms, when you accept the offer of products in the basket with the order button. The proposal can only be accepted, if the customer has accepted the terms and conditions by ticking of the “T&C accepted” square and thus accepts the conditions of contract as their own.
Just after sending off your order, you will receive a confirmation that your order has been received via e-mail (order confirmation). This is not a confirmation of your order, but is just the information that the order has been delivered to us. The transaction is complete, when you receive another e-mail which confirms the order itself: (Your Order has been fulfilled/Your order has been shipped) with that we confirm the transaction and the delivery. Should such a confirmation not have been sent within 3 work days after your order via e-mail, your order is no longer binding. In this case your payment will be refunded within 7 work days.


3. Language of contracts



The languages available for transactions are German and English.


4. Right of withdrawal, information and consequences



You have the right to revoke your contract within 14 days without needing to give an explanation.
This deadline of 14 days is counting from the day onwards, when you or a third party of your choosing, who is not the deliverer, has received the items of your order. To use your right of withdrawal, you have to send a clear statement about your wish to revoke this contract as a letter or e-mail to the following contacts:

You can use the attached form for this, but you can also write you own statement. To honour the deadline of your withdrawal, it suffices to send your statement within the stated timeframe of 14 days. 

Consequences of your withdrawal

When you withdraw from this contract, we have to pay back the payments we have received from you, including the costs of delivery (excluding any special delivery payment, if you haven’t chosen our standard delivery), within 14 days from the day of receival of your withdrawal statement. For the re-payment we will use the same payment channel through which we received the initial payment, the only exception with that would be if we make an agreement otherwise beforehand. In no case will there be a fine for the re-payment. We are within our rights to refuse re-payment until we have received the return of our wares or have proof that they have been sent back to us, whatever will occur first. 
You are obligated to return the items of your order to us (Tonmoden, Niehaeger Str. 5, 18347 Ahrenshoop) within 14 days after you send us your statement of withdrawal. This deadline is met, as soon as you sent us the items within the 14 days timeframe. 
You will carry the costs of the return delivery. These costs are estimated not to be higher than 10,00 EUR. 
The items have to be in a brand new, sell-able condition and all the tags have to be sound.
You only have to pay for damages to the items, if the damage can be traced to handling of the item that was not used to check the quality, features and function of the item.


5. Storage of the wording of a contract



TONMODEN stores the order of the customer along with the stated information for the order. TONMODEN also stores the order confirmation, which includes the terms and conditions within the contract. The customer can print the order and transaction confirmation, which they receive via e-mail from TONMODEN. The terms and conditions can be clicked, stored and printed during the order or after by the customer.


6. Taxes and payment



All prices are stated in Euro and include the legal sales tax (19%).

Advance Payment


If you chose advance payment, you will receive our bank data in a separate e-mail and we will deliver the wares after receiving the transfer of money.

PayPal Plus


With the services of PayPal Plus we offer you a spread of different payment methods through PayPal. You will be led to the website of Online provider PayPal. There you can enter your payment information, confirm the handling of your information by PayPal and confirm the money order to PayPal. With PayPal Plus, you can choose between the most popular payment methods: PayPal, debit, credit card or via invoice – even without having a PayPal Account.


7. Terms of delivery 



In addition to the price of products, a delivery cost will be added. Further information about this topic can be found in “Terms of delivery”.


8. Reservation of proprietary rights



The products remain the property of TONMODEN until they are fully payed. 


9. Warranty / Terms of guarantee



The legal warranty conditions of the Republic of Germany apply. Damages caused by natural wearing, improper handling or by lack or improper care are exempt from warranty. 


10. Settlement of disputes

We are not obligated and not willing to participate in a dispute resolution in front of a consumer conciliation committee.
